Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SendHQ platform, website, and API (collectively, the "Service").

1. The Service

SendHQ provides a platform and API for sending and receiving transactional email, managing sending domains, and monitoring deliverability. The Service is provided on an "as is" and "as available" basis.

2. Accounts and workspaces

When you create an account, you are responsible for maintaining the confidentiality of your credentials, including API keys. You agree to notify us promptly of any unauthorized use of your account. Each workspace is isolated; you are responsible for the domains, content, and email activity associated with your workspace.

3. Acceptable use and no-spam policy

You agree not to use the Service to:

• Send spam, unsolicited bulk email, or email that violates applicable anti-spam laws (including CAN-SPAM and GDPR where relevant).
• Send email that is fraudulent, deceptive, or that misrepresents its sender.
• Transmit content that infringes the rights of others or that is illegal.
• Interfere with or disrupt the integrity or performance of the Service.

We enforce a strict no-spam policy to protect deliverability for all customers. If your account's combined bounce or complaint rate remains above 3% for two (2) consecutive weeks, we will suspend the account from the platform. Reinstatement may require a review of your sending practices.

4. Domains and DNS

To send from your own domains you will add DNS records (SPF, DKIM, DMARC) that we generate for you. You are responsible for having the authority to make changes to the DNS for any domain you add, and for keeping those records in place while you use the Service.

5. Content and data

You retain ownership of the content you send through the Service. You grant us a limited license to process that content solely to provide the Service (for example, to route, store, and deliver email and to record delivery events).

6. Fees and billing

SendHQ is a paid service with no free tier. Plans are priced per month and differ by email type (transactional or marketing) and volume. Payments are processed by Dodo Payments. You are responsible for all fees associated with your account. We may update pricing with reasonable notice.

7. Suspension and termination

We may suspend or terminate access to the Service if you breach these Terms, if your usage harms the reputation or deliverability of the platform (including under the no-spam policy in section 3), or as required by law. We will provide notice where practicable.

8. Disclaimers and liability

The Service is provided without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, our aggregate liability arising out of the Service is limited to the amounts you paid us in the twelve (12) months preceding the claim.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
